Back in 1988 i was awarded legal custody of my 3 yr old daughter in fairbanks alaska .
my ex got visitation . upon her first visitation my ex and her b/f took off with my daughter .
I notified social services and was told tough she was the biological mother ,I showed the court order to the case worker and she just said she wasnt going to do anything since it was the biological mother . I then went to the police and showed them the court order and was told that i needed to hire a lawyer and get a writ of assist from the courts .
So now im on my own looking all over Alaska for my daughter because the authorities refuse to reconize one of there own court orders issued in fairbanks Alaska .
I spent 11 yrs looking for my daughter and heard from my ex sister inlaw that they had gone to the lower 48 .
So i went to montanna then calif then utah and still never located her .Every place i went and showed the court order and asked total strangers tried to help me .
I came back to Alaska where i owned a home in fairbanks and kept looking . i also met alot of bikers and truckers and other people that help me look .
Finally i was told by a person that i needed to use computers to locate my daughter and i received help do just that . finally i was told that my daughter might be in Kenny lake school and i got the information .
the social services just kept sending me letters that i owed support but they refused to tell me where my daughter was so that proves they knew where i lived and they knew where my daughter was . i contacted the school at kenny lake Alaska and after 11 yrs got to talk to my daughter .i told her not to tell anyone that i contacted her but the school notified my ex . i went to see my daughter and my ex was pissed . i talked to my daughter and bought her a pair of sorel boots and clothes for her birthday and told her i was going back to fairbanks to get the truck so i could move her to fairbanks .
shortly after i left she disappeared again and the house was empty spo the search was on again. this time i had given her a name and address of a biker friend and told her to contact him if anything happened . after 4 yrs of looking for her i finally left alaska and moved to minnesota still receiveing letters that i owed back child support and i still refused to acknolage it .Now im liveing in Minnesota and i get a call and its my daughter who is now 18yr old . she flew to minnesota from alaska and has been with me since . i Found out that after i left Kenny Lake the State social services had sent a case worker to the house along with the police , The police Arrested my Ex wifes B/f for rapeing my daughter and molesting 2 of the other children that he had from a prevouse marriage .The state of Alaska social services placed my daughter in foster care instead of notifieing me of what happened they with held all information from me and now they are garnishing my wages for 25000,00 . I went to court reprsenting myself and won the case and Registration for Alaska was denied .
Now they retried the same case with a diffrent judge and she overturned the first judges decision( Collatral Estopple ) states that you cant relidigate the same case again but the judge threatened me with contempt of court.
I am now fileing in federal court on the grounds that
1 I had legal custody and a crime was committed and that a person can not profit from a crime (a Tort)
2 the federal laws state that child services must make deligent inquireis of the location of both parents and any persons with interest in the child(relatives ,grandparents)
3 The fact that i can show in court papers that are addressed to me at my address proves that social services knew where i was and hid facts from me and took away the chance of haveing a relatonship with my daughter .
4 child enforcement has till the time my daughter is 21 to take action in court for back child support ( my daughter is 25 yrs old
5 under federal Law Alaska child support serves can not change or modifie a administrative order after a child is emancipated .
6 No court order was ever issued in Fairbanks Alaska ordering me to pay child support i was issued legal custody by a judge in Fairbanks if any support is be collected its from my ex wife .
